Privacy Policy
1. Who we are
Nicksy ("Nicksy", "we") is a trade name of Nicksy Sales & Marketing, operated by 2476871 Ontario Limited, based in Nobel, Ontario. This policy explains how we handle personal information under Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).
2. Our privacy contact
Brandon Nicksy is responsible for our privacy practices. Email [email protected] with questions, access requests or complaints.
3. What we collect
From you, through our website: name, email, phone, company and your message (contact form); name, email and booking details (Discovery Call calendar); your choice on any marketing-consent checkbox.
Automatically: basic technical data such as IP address, browser type and pages visited, through our website platform.
From our clients: when a client hires us for email work, we process their customers' contact and purchase data on the client's behalf (see section 7).
4. Why we use it
- To reply to you and schedule calls
- To provide and bill for the services you've engaged us for
- To send you occasional updates, only if you've agreed (you can unsubscribe any time)
- To keep our systems secure and meet legal and tax obligations
We don't sell personal information.
5. Consent
We collect and use personal information with your consent, which you can withdraw at any time, subject to legal or contract limits. Marketing email follows Canada's anti-spam law (CASL).
6. Who we share it with
We use trusted service providers to run our business, who may only use the data to provide their service to us:
- HighLevel (GoHighLevel) — website, forms, calendar, CRM and email
Some providers store data outside Canada, including in the United States, where it may be subject to local laws.
We may also disclose information where the law requires it.
7. Client data we handle as a service provider
When we run email for a client, the client controls its customer list and is responsible for how it was collected. We use that data only to deliver the agreed services, protect it, and return or delete it at the end of the engagement, as set out in our client agreement.
8. How long we keep it
We keep personal information only as long as needed for the purposes above or as required by law (for example, tax records).
9. How we protect it
Access is limited to people who need it, accounts use strong passwords and two-factor authentication where available, and client data is kept in separate accounts.
10. Breaches
If a breach creates a real risk of significant harm, we will notify affected people and the Office of the Privacy Commissioner of Canada, and keep a record of all breaches, as PIPEDA requires.
11. Your rights
You can ask to see the personal information we hold about you, ask us to correct it, or withdraw consent. We'll respond within 30 days. If you're not satisfied, you can contact the Office of the Privacy Commissioner of Canada at priv.gc.ca.
12. Changes
We may update this policy. The date at the top shows the latest version.
